Terms of Service

Lectly is a pre-launch software project operated from Poland and available at lectly.net. It provides an AI-assisted workspace for private tutors and their students. You can contact us at [email protected].

By creating an account or using Lectly, you agree to these Terms. If you use Lectly for an organization or tutoring business, you confirm that you may accept these Terms for it. If you do not agree, do not create an account or use the service.

Nothing in these Terms limits rights that cannot lawfully be limited, including mandatory rights available to consumers under Polish or EU law.

Lectly supports lesson planning, AI-generated educational materials, homework, practice, student progress, tutor–student messaging, scheduling, file uploads, invitations, and optional Google Calendar and Google Meet connections. Available features may change during the pre-launch period.

You need a current web browser, internet access, JavaScript, cookies required for authentication and preferences, and a working email address. Some features require a compatible file type, a third-party account, or permission from a tutor.

An agreement for the free electronic service is formed when an account is created or a visitor submits the waitlist form. It lasts until the account or request is withdrawn, deleted, or terminated under these Terms.

• Tutors must be at least 18 years old and must provide accurate account information.
• Student accounts are created through a tutor invitation and must use the invited email address.
• A student under 18 may use Lectly only with authorization from a parent or legal guardian. The tutor sending the invitation must have a lawful basis to provide the student's details and must obtain any guardian authorization required for the tutoring relationship and use of Lectly.
• Where processing relies on consent and a student is under 16, the consent must be given or authorized by the holder of parental responsibility. This includes choosing optional analytics cookies.
• Account credentials are personal. Tell us promptly if you believe an account has been accessed without permission.

Tutors decide why student teaching records are created and how they are used in the tutoring relationship. Tutors are responsible for giving students and guardians appropriate information, respecting their rights, keeping records accurate, and collecting only data reasonably needed for teaching.

Do not add a student, upload their work, or send their information to AI features unless you have a valid legal basis and any required guardian permission. Do not use Lectly as the sole official record for grades, attendance, safeguarding, or other decisions with legal or similarly significant effects.

To the extent Lectly processes educational records solely on a tutor's documented instructions, Lectly acts as a service provider to that tutor. Tutors who require a data processing agreement should contact us before placing personal data in Lectly.

You keep your rights in lesson text, files, messages, answers, and other material you submit. You give Lectly a non-exclusive license to host, copy, transform, transmit, and display that material only as needed to operate, secure, and improve the service and to generate requested output.

You must have the rights and permissions needed for everything you upload. Deleting source material may not remove information already incorporated into a lesson, submission, message, or record that must remain available to another authorized user.

Lectly and its licensors own the service, interface, branding, and software. These Terms do not transfer those rights to you.

AI output can be incomplete, inaccurate, biased, unsuitable for a learner, or similar to output produced for someone else. Tutors must review AI-generated lessons, answers, feedback, code, citations, and safety implications before using them. AI output is an aid, not a substitute for professional judgment or supervision.

You must not use Lectly to:

• break the law, infringe rights, harass, exploit, or endanger another person;
• upload unlawful content, malware, stolen material, or content you are not permitted to use;
• store passwords, payment-card details, government identifiers, medical records, biometric data, or other special-category or highly sensitive information;
• circumvent access controls, quotas, security, or account restrictions;
• scrape, reverse engineer, disrupt, overload, or probe the service except where applicable law expressly permits it;
• impersonate another person, falsify educational records, facilitate cheating, or present unchecked AI output as verified fact;
• use the service to train a competing model or build a competing dataset without written permission.

We may remove content or restrict access where reasonably necessary to protect users, comply with law, investigate misuse, or preserve service security.

Lectly relies on service providers for authentication, hosting, database operations, file storage, AI generation, and optional analytics. Optional Google Calendar and Meet features are governed by your Google account permissions and Google's terms. Third-party services may change or become unavailable, which can affect a related Lectly feature.

Lectly does not currently offer live paid subscriptions. We will not charge you unless pricing, renewal, cancellation, consumer withdrawal, and payment terms are shown and expressly accepted before purchase. Introducing a paid plan will not create a payment obligation for an existing user without that user's affirmative agreement.

Lectly is under active development. Features may contain errors, change, or be withdrawn. We do not promise uninterrupted availability or that the service will meet every curriculum, accessibility, compatibility, or teaching requirement.

We use reasonable care to provide and secure the service. You should keep separate copies of important material and use appropriate professional judgment when relying on the service.

You may stop using Lectly at any time. You may request account or data deletion by emailing [email protected]. A tutor may remove a student from the tutor's workspace; some linked lesson history may remain where another authorized user still needs it or retention is required by law.

We may suspend or terminate access for a material or repeated breach, security risk, legal requirement, non-use, or discontinuation of the service. Where reasonable, we will provide notice and an opportunity to correct the issue or retrieve user-provided content.

Send service complaints to [email protected] with the account email, a description of the issue, when it occurred, and the outcome you request. Do not include passwords or unnecessary student information. We will acknowledge the complaint and aim to respond within 14 days.

Each party is responsible for loss it causes in accordance with applicable law. To the maximum extent permitted by law, Lectly is not responsible for indirect or unforeseeable loss, lost opportunities, loss caused by unchecked AI output, or failures of an optional third-party integration.

These limitations do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, data-protection obligations, or any liability or consumer remedy that cannot lawfully be excluded or limited.

Polish law governs these Terms. If you are a consumer, this choice does not deprive you of mandatory protections of the country where you habitually live, and you may bring proceedings in any court made available by mandatory consumer law.

We may update these Terms for legal, security, technical, or service changes. We will post the revised version and update its date. For a material change affecting registered users, we will provide reasonable advance notice where required. Continuing to use the service after the effective date means accepting the revised Terms; if you disagree, you may stop using Lectly and request account deletion.
